When you are charged with a federal offense, your case is prosecuted in front of a federal judge by an Assistant U.S. Attorney, and you are subject to the consequences mandated by federal laws.
When you are arrested by federal agents or charged with a federal offense, you need the assistance of a skilled and aggressive defense attorney who is authorized to practice in federal courts. David Higdon, a federal defense attorney in McAllen, is prepared to handle your case and vigorously defend your rights.
If you are charged with a crime and are arrested by your state or local police department, you will almost certainly face state-level charges. This means that Texas prosecutors are accusing you of breaking a state law. In state courts, you will go through the criminal court process. Many crimes, however, also violate federal law. In some cases, federal charges may be brought against you by prosecutors working for the federal government. Your case will be heard in federal court, and if convicted, you will be sentenced in accordance with federal law rather than state law.
Federal offenses are frequently harshly punished. Working with Higdon Law Firm increases your chances of being exonerated in court or minimizing the consequences of a conviction.

- Federal officers were involved in the crime.
Common Federal Charges
Federal prosecutors typically handle specific types of criminal activity. This is because some offenses are only prosecutable by the federal government.

Federal Court
If you are charged with a federal crime, the federal court process will be very different from what you would go through if you were charged with a state-level offense in Texas. You can be arrested before charges are filed and even before a federal prosecutor presents evidence against you to a grand jury. If you are arrested, the prosecutor has the option of going before a grand jury while their investigation is ongoing, or they can present their evidence within a week of your arrest. However, prosecutors can summon a grand jury after an investigation and before your arrest.
A federal grand jury will consist of 16 to 23 people and will meet in private. Prosecutors present evidence proving that you committed the crime. Your lawyer does not present evidence or cross-examine witnesses. You may, however, testify before the grand jury to present your side of the story. The grand jury then deliberates, not to determine your guilt, but to determine whether there is sufficient evidence to support your guilt. A grand jury, on the other hand, is not always required. Prosecutors may file a misdemeanor crime complaint and then hold a preliminary hearing.
Following charges, you will appear before a magistrate judge for the first time to learn about the charges against you and the conditions for your possible release from jail. Your next court appearance will be your arraignment, which will occur within 10 days of your indictment. You are officially a defendant after your arraignment and must enter a plea. You may be required to attend numerous pre-trial hearings in the coming months or years. Unless you plead guilty or accept a plea bargain, your case will proceed to trial, where your McAllen federal defense attorney will present your defense.
Federal Penalties
You may face a variety of penalties and collateral consequences depending on the specifics of your criminal conduct, the level of the federal offense, and your criminal history, including:
- Having a permanent criminal record
- A jail sentence
- Probation\Fines
- Registration of a sex offenders
- Ineligibility for certain professional licenses or positions in government
Ineligibility for military service - Ineligibility to run for federal office
- Voting rights are being revoked.
- You will lose your right to own firearms.
- Travel constraints
- Loss of your visa or permanent residency status, or refusal to renew your visa
- Your citizenship application was denied.
